DEFINITIONS:

"The Hirer" means the person paying for the room.

“The Premises” means the building or part of the building booked.

“Onyx” is the hotel located at Schoolkaai 31, 9000 Ghent, and is owned by Marasquin.

“The Onyx staff” means the Onyx Manager or any person or persons nominated by him/her.

GENERAL TERMS AND CONDITIONS: 

1. Purpose.

  • The renter must be either a couple (x,x), a mixed-gender couple, and a guest, or two mixed-gender couples. More than two men in one room are not permitted. No escorts, no overnight stays.

  • The tenant may only use the premises, or allow the premises to be used, for personal occupancy, in compliance with legal obligations, such as the COVID-19 regulations in 2020. No photography, filming, or live streaming without Onyx’s approval; what happens at Onyx stays at Onyx.

  • Reservations can be made by phone, WhatsApp, or during a previous visit; however, only a written confirmation constitutes a valid reservation.

2. Damage.

  • The hirer shall take good care of, and shall not cause any damage or permit any damage to be done to the premises, or any part of the premises or the fixtures, fittings and equipment on the premises or to any part of the building. Any damage caused or permitted by the hirer or any other person resorting to the premises by reason of his/her hire of them shall be made good at the cost to the hirer.
    The hirer shall inform the Onyx staff of any such damage as soon as practical and the hirer shall immediately settle or indemnify the damage occurred.

3. Responsibility.

  • The hirer shall be liable for and shall indemnify Onyx against all actions, proceedings, claims, damages, charges, costs, e
    expenses whatsoever brought or made against Onyx in respect of any damage, theft, or loss of property, goods, articles, or things placed, deposited, brought into, or left upon the premises or other part of the building of which the premises forms a part either by the hirer for his use or by any other person using the premises by reason of his/her hire unless due to the negligence of the Onyx staff.

  • Onyx shall not be liable for any loss due to any industrial action, breakdown of machinery, failure of electricity supply,
    , water leakage, fire, government restrictions, or any other circumstances beyond its reasonable control, which may cause the premises or any part thereof to be temporarily closed or the hiring to be interrupted or canceled, nor for any failure of the hirer to gain access to the premises unless due to negligence of Onyx staff.

  • The renter and others present under the rental agreement shall comply with Belgian law with regard to age, illegal substances, and prostitution.

  • The hirer shall be liable for, and shall indemnify Onyx against all actions, proceedings, claims, damages, charges, costs, expenses whatsoever brought or made against Onyx in respect of any personal injury to or the death of any person arising out of or in the course of the hire of the premises by the hirer, unless due to negligence of the Onyx staff.

  • The Onyx staff can refuse entry at any time without further explanation.                         

  • The hirer and others present under the hire shall, during the hire in the premises, comply with all requirements of the Onyx staff.

4. Conduct.

                   4.1 General.

  • The orderly and safe entry and exit of people to and from the premises. In the event of an emergency, assisting the Onyx staff officer in the orderly and safe evacuation of the premises.

  • The tenant will keep the premises safe and ensure good order, decency, and hygiene.

  • The tenant will keep the exits from the premises unobstructed and immediately available for use in case of an emergency.

                 4.2 Misconduct.

  •  If, in the opinion of the Onyx manager, you fail to comply with clause 4.1, he or she shall be permitted to suspend or terminate your stay. Onyx will not be liable for any damages arising from the termination or suspension unless such damages result directly from the negligence of Onyx staff.

                4.3 Use.

  • The renter shall maintain the premises in good condition, ensuring that they can be cleaned with a reasonable amount of effort. Additional cleaning will cost 30 euros per hour.

  • Smoking is prohibited in the building and on the premises.
    Smoking in the rooms will result in 3 hours of forced ventilation, billed at Onyx rates.

  • Alcohol or drugs may not be brought onto or consumed on these premises.

  • No animals are allowed on the premises or inside the building.

  • Onyx only accepts food deliveries if they are prepaid; staff will leave them at your room door.

  • The lessee and any other parties covered by this lease must vacate the premises by the end of the lease term. If they have not done so, the lessee will be required to pay Onyx a surcharge equal to Onyx’s standard rental rate for the premises until the premises have been vacated.

  • No alterations or additions may be made to the premises, the fixtures, fittings, scenery, and/or equipment, or the decorations at the premises.

  • The use of any equipment provided by Onyx is at the renter’s own risk, and Onyx will accept no liability or responsibility for it unless any damage to it is due solely to the negligence of Onyx staff.

  • The lessee shall be fully liable and responsible for any loss or damage to the premises or any part thereof, or to its fixtures and fittings, or to any of Onyx’s equipment used by the lessee or by persons permitted on the premises by virtue of the lease.

  • The lessee shall not move or remove any furniture, fixtures, or equipment.

  • The lessee may not grant any rights related to sound, television broadcasting, filming, or photography without the prior written consent of the Onyx staff.

  • Onyx will provide heating, lighting, a Smart TV, Sonos, and Wi-Fi for the premises, but shall not be liable for any failure or defect thereof that results in loss or damage. 

5. Booking & Cancellation.

  1. Bookings can be made by phone or WhatsApp. A customer may have only two active bookings at any given time.

  2. Bookings can be canceled free of charge up to 4 hours before the scheduled time; last-minute cancellations may incur a 20-euro cancellation fee.

  3. Onyx may terminate the rental at any time without providing a reason; in such cases, Onyx shall refund to the renter all amounts paid by him or her, if applicable.

  4. If a renter is more than 20 minutes late and has not contacted the Onyx staff, the reservation will be canceled and a cancellation fee of 20 euros will always be charged.
